To help streamline this process and avoid delays or unexpected fees, we&#8217;ve updated our customs clearance workflow.&nbsp;<\/p>\n\n\n\n<p>This article will guide you through each step to ensure you\u2019re prepared for your shipment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-1-start-your-quote\">1. Start Your Quote<\/h2>\n\n\n\n<p><strong>New Requirement:<\/strong><strong><br><\/strong>For any non-tooling quote, once files are uploaded, you\u2019ll be asked to identify the <strong>end-use<\/strong> of the parts (Prototype or Commercial). You may continue configuring without answering this question, but you <strong>must<\/strong> answer it to receive pricing. This applies to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>New quotes<\/li>\n\n\n\n<li>Reorders<\/li>\n\n\n\n<li>Existing quotes<\/li>\n<\/ul>\n\n\n\n<p>This classification impacts the <strong>tariffs and duties<\/strong> applied to your parts.<\/p>\n\n\n\n<p>Choose between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Prototype<\/li>\n\n\n\n<li>Commercial<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"2048\" height=\"748\" data-src=\"https:\/\/www.fictiv.com\/wp-content\/uploads\/2025\/08\/unnamed.png\" alt=\"Fictiv platform end-use selection prompt (Prototype or Commercial) required to view pricing.\" class=\"wp-image-20657 lazyload\" data-srcset=\"https:\/\/www.fictiv.com\/wp-content\/uploads\/2025\/08\/unnamed.png 2048w, https:\/\/www.fictiv.com\/wp-content\/uploads\/2025\/08\/unnamed-768x281.png 768w, https:\/\/www.fictiv.com\/wp-content\/uploads\/2025\/08\/unnamed-1536x561.png 1536w\" sizes=\"auto, (max-width: 2048px) 100vw, 2048px\" \/><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>If you\u2019re unsure whether your parts qualify as prototypes, the U.S. Customs and Border Protection (CBP) <a href=\"https:\/\/www.ecfr.gov\/current\/title-19\/chapter-I\/part-10\/subpart-A\/subject-group-ECFR7d8b7e63e05d740\">defines a prototype<\/a> as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The part is to be used exclusively for development, testing, product evaluation, or quality control purposes.<\/li>\n\n\n\n<li>The part is NOT intended to be sold or incorporated into other products that are sold.<\/li>\n\n\n\n<li>The order is limited to noncommercial quantities in accordance with industry practice.<\/li>\n<\/ul>\n\n\n\n<p>Anything that does not fit in the Prototype classification will be Commercial.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-2-select-end-use-and-receive-pricing\">2. Choose Import Method<\/h2>\n\n\n\n<p>On the checkout page, you\u2019ll be required to choose how you want parts imported. <a href=\"https:\/\/www.fictiv.com\/help\/placing-an-order\/know-the-full-cost-upfront-with-built-in-ddp-ior-services\">Learn more about your import options here.<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-import-options-ddp-vs-ex-works\"><strong>Import Options (DDP vs. Ex Works)<\/strong><\/h3>\n\n\n\n<p><strong>Default: Fictiv Imports (DDP)<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Fictiv handles all importation logistics.<\/li>\n\n\n\n<li>The quote total <strong>includes all costs<\/strong>\u2014what you see is what you pay.<\/li>\n\n\n\n<li>This is the <strong>recommended option<\/strong>, especially for a frictionless experience.<\/li>\n<\/ul>\n\n\n\n<p><strong>Alternate: Customer Imports (Ex Works)<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The customer acts as the importer of record.<\/li>\n\n\n\n<li>Requires a <strong>valid shipping account<\/strong>.<\/li>\n\n\n\n<li>Customer assumes full responsibility for all customs clearance, duties, and tariffs.<\/li>\n<\/ul>\n\n\n\n<p>For Ex Works shipments, you are responsible for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Submitting the Importer ID Form (CBP Form 5106) (see below)<\/li>\n\n\n\n<li>Providing accurate HTS codes to ensure timely and compliant customs clearance<\/li>\n\n\n\n<li>Paying all applicable import duties, taxes, and fees. These are collected by U.S. Customs upon import. A few days after delivery, your carrier (e.g., FedEx, UPS, or DHL) will invoice you for these charges<\/li>\n\n\n\n<li>If Prototype is selected, at the time of entry (or at a later date), you may be required to provide U.S. Customs with a written statement confirming the actual use of your parts, along with any supporting documentation for prototype certification. If CBP determines that your parts do not qualify as prototypes and sufficient proof cannot be provided, the customer will be responsible for any resulting tariffs or duties.<\/li>\n<\/ul>\n\n\n\n<p>Failure to provide this information can result in:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Customs holds that delay delivery<\/li>\n\n\n\n<li>The shipment being returned if the CBP Form 5106 is missing or unresolved in a timely manner<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-5-confirmation-and-next-steps\">5. Fictiv works with our trade partner to determine the correct HTS code based on your part description and end-use details.<\/li>\n\n\n\n<li>If you selected <strong>Ex Works<\/strong>: You are responsible for providing the HTS code. To find the correct code(s), visit the <a href=\"https:\/\/hts.usitc.gov\/\">official HTS website<\/a>. Fictiv generates the necessary documents, acts as the <strong>Importer of Record (IOR)<\/strong>, and coordinates clearance with our customs broker.<\/p>\n\n\n\n<p><strong>First-Time Importers<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You must register an importer profile with U.S. Customs and Border Protection (CBP). If you or your business have not submitted these documents before, please review the steps below.&nbsp;<\/li>\n\n\n\n<li>Your carrier will contact you if document submission is required.<\/li>\n\n\n\n<li>You must also have a POA on file with your carrier or customs broker, allowing them to file paperwork on your behalf.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-how-to-register-an-importer-profile\"><strong>How to Register an Importer Profile<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"aioseo-step-1-complete-cbp-form-5106\"><strong>Step 1: Complete CBP Form 5106<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.cbp.gov\/sites\/default\/files\/assets\/documents\/2019-Jun\/cbp-form-5106.pdf\">Download CBP Form 5106<\/a> (Entry Identification Form).<\/li>\n\n\n\n<li>This form establishes or updates your importer profile with CBP, which is required for goods entering the U.S.<\/li>\n\n\n\n<li>You only need to submit Form 5106 once per importer profile.<\/li>\n<\/ul>\n\n\n\n<p><strong>When is it required?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If your incoterms are <strong>EXW<\/strong> and you do not already have a Form 5106 on file with CBP, the express consignment operator (e.g., FedEx) will request it.<\/li>\n\n\n\n<li>If you\u2019re using your <strong>own carrier<\/strong> (not Fictiv DDP), you must be registered as an importer with both your carrier and CBP by submitting this form.<\/li>\n<\/ul>\n\n\n\n<p><strong>Information you\u2019ll need to complete Form 5106:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Company EIN (Employer Identification Number) or your Social Security Number (SSN)<\/li>\n\n\n\n<li>Company shipping and billing addresses<\/li>\n<\/ul>\n\n\n\n<p><strong>Important:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You cannot submit the form to the express consignment operator until after your goods have shipped and you\u2019ve received a tracking number.<\/li>\n\n\n\n<li>Failure to provide the form upon request may result in customs holds and shipment delays.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"aioseo-step-2-power-of-attorney-poa\"><strong>Step 2: Power of Attorney (POA)<\/strong><\/h4>\n\n\n\n<p>If you are a first-time importer, ensure you also have a <strong>Power of Attorney (POA)<\/strong> on file with your carrier or customs broker. This allows them to file customs paperwork on your behalf.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-when-do-i-need-a-power-of-attorney-poa\"><strong>When Do I Need a Power of Attorney (POA)?<\/strong><\/h3>\n\n\n\n<p>If you are acting as the Importer of Record (IOR) for a shipment into the U.S., you must have a <strong>Power of Attorney (POA)<\/strong> on file with your customs broker. This is typically the brokerage division of your selected shipping carrier. The POA authorizes the broker to clear your goods through U.S. Customs on your behalf. Failure to provide a POA may result in shipment delays.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-verifying-poa-status-with-ups\"><strong>Verifying POA Status With UPS<\/strong><\/h3>\n\n\n\n<p>UPS is one example of a carrier that requires a POA.
